ContentFans is a social network that allows users to share their content so that other users can see and enjoy the content. We refer to the users who share content as "Creators" and those who view and pay for the content as "Fans". This Privacy Policy describes how we collect and process your personal data through our website www.contentfans.com, the services we offer and our associated social media sites (Twitter and Instagram) or your interactions with us, all of which we rely on obtain as "Services".
By accessing or using any of our Services, you confirm that you have read and understood this Privacy Policy and that you agree to our practices. Please read this privacy policy regularly as it will be updated from time to time.

Below is our statement on the personal information we collect from users. "Personal Data" means information that identifies or relates to a specific consumer or household. We may also collect information that is not identifiable or linked to an individual, such as: B. a) Access, change, rectify and correct collected personal data

We strive to ensure the accuracy of any Personal Information we collect from you and will attempt to promptly update our records if you notify us that any information in our records is inaccurate. However, we rely on you to ensure that the information you provide to us is complete, accurate and up to date and to notify us of any changes. Please check all of your information carefully before submitting it to us. You can update or correct your information through your account settings.
Depending on the laws that apply to you, you may be entitled to certain personal information in our records. If you would like to access, review, or change any Personal Information that you have provided to us through the Services, please contact us using the information provided at the end of this Privacy Policy. We reserve the right to refuse access where permitted or required by applicable law.

As a California resident, you have the right to request and receive from us a list of what personal information (if any) we have shared with third parties for their own direct marketing purposes in the preceding calendar year and the names and addresses of those third parties, in accordance with the California Shine the Light Law. You can make such a request once a year free of charge by contacting us at the email address below. Please note that we do not provide personally identifiable information protected under the Shine the Light Act to third parties for their own direct marketing purposes.

    4. Exercising freedom of expression, guaranteeing another consumer’s right to freedom of expression, or exercising any other right provided for by law.
    5. Compliance with the California Electronic Communications Privacy Act under Chapter 3.6 (commencing with Section 1546) of Title 12 of Part 2 of the Criminal Code.

To engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that complies with all other applicable ethics and privacy laws, when deletion of the information is likely to render impossible or seriously impair the conduct of such research, when you have provided informed consent .
    7. Allow only internal uses that are reasonably aligned with your expectations based on your relationship with us.

    9. Otherwise, use the personal information internally in a lawful manner that is compatible with the context in which you provided the information.
       
  4. Right to Opt-Out/In: You have the right to opt-out of the sale of your personal information. You also have the right to consent to the sale of personal information. However, we do not sell your personal data.
     
  5. Right to Non-Discrimination: You have the right not to be discriminated against by us for exercising your privacy rights under the CCPA. Except as permitted by the CCPA, we will not:

If you have an account with us, you can exercise all of the above rights from your profile. If you do not have a profile or are unable to access, control or delete your profile information, you may contact us using any of the methods set out above.
Only you, or someone authorized by you and acting on your behalf, may make a verifiable consumer request related to your personal information.
 
You may only make two verifiable consumer requests for access or data portability within a 12-month period. Your verifiable consumer request must:

  1. Provide sufficient information to enable us to reasonably verify that you are the individual about whom we collected personal information or an authorized representative. Depending on the nature of the request, we may need to verify your identity through an additional Ondato verification cycle that requires government issued ID and a photo that requires your presence through the a (see the Identity Verification section below for more information).
  2. Describe your request in sufficient detail so that we can correctly understand, evaluate and respond to it.

We may refuse your request if we cannot verify your identity or have reason to believe the request is fraudulent.
If an authorized agent submits a consumer request on your behalf, we require proof that you have provided the authorized agent with signed permission to submit the request, along with information sufficient to verify the identity of the authorized agent, depending on the nature of the request. In order to verify your identity, depending on the nature of the request, we may require a valid government-issued ID (not expired), an email address and the last 4 digits of your social security number. Please email privacy@contentfans.com to confirm the identity of the authorized representative.
 
If we are unable to verify your identity or authority to make a request or to confirm that the personal information concerns you, we will not be able to respond to your request or provide you with personal information. An account with us is not required to make a verifiable consumer request, but if you have one you will need to log in to make a request. Personal information provided in a verifiable consumer request will only be used to verify the identity or authority of the request.
Upon receipt of the request, we will acknowledge receipt within ten (10) business days. We will respond to a verifiable consumer request within forty-five (45) days of receipt. If we need more time (up to 90 days), we will inform you in writing of the reason and the extension period. If you have an account with us our written response will be sent to that account, otherwise electronically. All disclosures provided cover only the 12-month period preceding receipt of the verifiable consumer request. Where appropriate, our response will also explain why we are unable to honor a request. For data portability requests, we will provide the relevant information in a portable and easily usable format to the extent technically feasible,
We do not charge a fee to process or respond to a verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that a charge is warranted, we will explain why we made that decision and provide you with an estimate before we finalize your request.
 

c) Your Nevada Privacy Rights

Under Nevada law, our users who are Nevada consumers have the right to request that their personal information not be sold (as defined by applicable Nevada law), even if their personal information is not currently being sold. Requests can be sent to privacy@contentfans.com and are free of charge.
 

d) Your European Union and UK data protection rights

Individuals in the European Union and the United Kingdom have additional data protection rights in relation to their personal data in addition to the rights set out above. Depending on the circumstances of the processing of personal data, these rights may include:

The right to object to decisions based on profiling or automated decision-making that produce legal or similar significant effects on you;
 
The right to request restriction of processing of personal data or to object to processing of personal data which is based on (i) legitimate interest (including but not limited to processing for direct marketing purposes) or (ii) the performance of a task in the public Interest;
 
The right to data portability, which allows you to request that we provide certain personal information we hold about you in a machine-readable format; and

The right to erasure and/or the right to be forgotten, which enables you to request the erasure or removal of certain personal data that we process about you.

13. OPTIONS AVAILABLE TO YOU

You have the opportunity to choose certain aspects of our handling of your personal data, including the information we collect, how we communicate with you and how we process your personal data. If we request information from you, you can refuse to provide it. However, please note that if you refuse to provide information necessary to use some of our services, you may not be able to access these services. In addition, you can change your browser settings to prevent the automatic collection of certain information.

14. PROTECTION OF PERSONAL DATA

We implement reasonable and appropriate physical, technical and organizational measures to ensure the security and confidentiality of personal data and to promote its integrity, availability and resilience. These measures include (i) encryption of personal data where necessary, (ii) data backup to ensure availability in the event of a security incident, and (iii) periodic testing, assessment and evaluation of the effectiveness of our security measures.
 
However, while we take steps to protect personal information, we cannot guarantee that our safeguards will be fully effective or adequate. It is also important to note that data transmission over the Internet is not always secure and we cannot guarantee the security of information transmitted through our Services.
 

15. RETENTION OF PERSONAL DATA

We store personal information for six (6) months after a user closes their account. We may retain certain personal data for longer periods where this is necessary to carry out the processing activities described above, including to comply with applicable laws and regulations, to respond to requests from law enforcement or government agencies and to protect the rights, property and safety of us and our partners, as well as those of our users and third parties. We are required by law to retain certain financial information for seven (7) years.
 

16. IMPORTANT INFORMATION ABOUT PERSONAL DATA AND OUR SERVICES

a) Identity Verification
Part of our commitment is to ensure that our Services are not offered to anyone under the age of 18 or to anyone with a false identity. Therefore, we require creators to undergo reviews. 
 
b) Payment information
Payments made by fans to access content are processed by third parties. When you make a payment, you provide the payment provider with your credit card number, expiration date, and security code, which they will process and store in accordance with their privacy policy and terms of use. We do not receive your full credit card information. Instead, we receive a "token" representing your account, along with the expiration date, card type, and the first two and last four digits of your card number. If you provide the payment provider with your name and email address, we will receive this information. Payments to creators are made using bank account information we collect and store.
 
c) Collection of personal data from minors
Our Services are intended only for users who are 18 years of age or older. If you are under the age of 18, you may not use our Services. We do not knowingly collect personally identifiable information from anyone under the age of 18. By using our Services, you confirm that you are 18 years of age or older.
 
d) Third-Party Websites and Services
We may provide links or pointers to third party websites and services for your convenience. These Third Party Services may include services from unaffiliated third parties, our affiliates, service providers and other parties with whom we do business. If you access these third-party services, you will leave our services, and we are not responsible for the content, security, or privacy practices of any third-party websites or services. You assume all risks associated with the use of these third party services. Our privacy policy does not apply to third-party services. Information about how third-party services collect, use and process personal data,
 
e) Business Transfer

Your personal data may be stored and processed in different countries, including the United States and the European Union. By using our Services, you acknowledge that we may transfer and store your personal information to those countries which may have different data protection laws than your country. Your personal information may be accessible to law enforcement and/or national security authorities in those countries to the extent permitted by law. For data transfers to and from the European Economic Area, we use data transfer agreements with EU-approved standard contractual clauses in accordance with Article 46 of the General Data Protection Regulation.
